What is a Cohabitation Agreement?
Instead of getting married or entering into a civil partnership or any other legally recognised relationship, more and more couples are choosing to live together. Unfortunately cohabitation is not legally recognised and thus the couples do not enjoy the same legal rights that married couples or couples that have entered into a civil union enjoy. This can lead to uncertainty when couples have joint or shared assets and the impact that seperation will have on such joint or shared assets.
A cohabitation agreement (or life partnership agreement) is an agreement entered into parties living together. This agreement will set out the ownership of assets in the relationship, the parties’ financial obligations towards each other and how jointly owned assets or savings will be distributed should the parties seperate.
What should be included in a Cohabitation Agreement
Each cohabitation agreement is drafted according to the couples individual circumstances. However some of the common aspects that should be dealt with in the cohabitation agreement includes:
1) Assets and property owned before moving in together;
2) Assets and property bought while living together;
3) Inheritance and wills;
4) Household bills and the parties financial obligations towards each other;
